Terms of Service
These Terms govern your access to and use of the Provantis platform
(“Provantis”, “the Platform”, “we”, “us”).
The Platform is operated by Provantis (Pty) Ltd
(“Provantis”), registration number 2014/122780/07,
a company incorporated under the laws of the Republic of South Africa.
Last updated: 1 April 2026
1. Nature of the service
Provantis provides automated readiness diagnostics for South African short-term
insurance brokers, underwriting managers and related intermediaries. The Platform applies
a rule library, weighted scoring engine, and AI-assisted summarisation to publicly observable
signals from your domain — and, where applicable, to your own self-attestation responses.
Provantis is not a regulatory audit, legal opinion, or a FAIS / POPIA / FICA / TCF /
Joint Standard 2 of 2024 attestation. Provantis is not a registered Financial Services Provider
and does not perform statutory audits, attestations, or representations of compliance. Findings
generated by the Platform are informational and must be reviewed and signed off
by a licensed compliance practitioner, attorney or external auditor before they are relied upon
for remediation, board reporting, or regulatory submission.
2. Eligibility and account responsibility
You must be at least 18 years of age and authorised to bind the entity on whose behalf you
register an account. You are responsible for keeping your credentials confidential and for all
activity carried out under your account. You must notify us immediately of any suspected
unauthorised access by emailing support@provantis.co.za.
3. Acceptable use — scanning scope
You may only submit domains and digital journeys that you own, control, or have explicit
written authorisation to assess. Submitting a third-party domain without authorisation may
breach the Cybercrimes Act 19 of 2020 and the Electronic Communications and Transactions Act
25 of 2002. You indemnify Provantis against any third-party claim arising from unauthorised
submissions.
The Platform may not be used to:
- circumvent rate limits, authentication, or access controls;
- conduct denial-of-service activity or vulnerability exploitation;
- scrape or redistribute the Platform’s rule library, score engine or AI output;
- misrepresent Provantis output as a regulator-issued certification or audit opinion.
4. AI-generated content
The Platform uses third-party large language models from two providers:
Anthropic’s Claude models power the SENTINEL compliance assistant (chat, drafting
and remediation plans), the Regulatory Intelligence scanner and the Document Scan
feature, and OpenAI’s gpt-4o-mini summarises scan findings in plain
English. AI output is generated automatically and may contain errors, omissions, or stale
references. You must independently verify every AI-generated statement before acting on
it. AI output does not constitute professional advice and is provided “as is”.
5. Intellectual property
The Platform, its rule library, scoring engine, citations, designs, source code and
AI-prompt frameworks are the exclusive property of Provantis (Pty) Ltd
and are protected by South African and international copyright law. You receive a limited,
non-exclusive, non-transferable licence to access the Platform during a paid subscription
term.
You retain ownership of all customer data, scan inputs, attestation answers and uploaded
content (collectively, “Customer Data”). You grant Provantis a limited licence to
process Customer Data solely for the purpose of operating the Platform and producing your
reports.
6. Fees, billing and cancellation
The free public scan and free Cyber Trust Score remain free as a lead-magnet feature.
Multi-journey scans, branded executive PDF reports, recurring monitoring, the Cyber-insurance
Evidence Pack, the IRP Generator and authenticated dashboards are paid features. Subscription
fees, billing cadence and cancellation terms are disclosed at the point of subscription. No
refunds are issued for partial billing periods unless required by law.
7. Limitation of liability
To the fullest extent permitted by law, Provantis’ aggregate liability arising out of or
in connection with the Platform — whether in contract, delict or otherwise — is
limited to the fees actually paid by you to Provantis in the twelve (12) months immediately
preceding the event giving rise to the claim. Provantis is not liable for any indirect,
incidental, special, consequential or punitive damages, or for any loss of profit, revenue,
goodwill, regulatory standing, or business opportunity, even if advised of the possibility of
such loss.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any
liability that cannot lawfully be excluded under South African law (including the Consumer
Protection Act 68 of 2008 where applicable).
8. Suspension and termination
Provantis may suspend or terminate your access immediately and without prior notice if you
breach these Terms, threaten the integrity of the Platform, or fail to pay applicable fees.
You may terminate your account at any time from your dashboard settings. On termination,
your access is revoked and Customer Data is retained or deleted in line with the Privacy
Policy.
9. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out
of or in connection with these Terms is subject to the exclusive jurisdiction of the High
Court of South Africa, Gauteng Division, Johannesburg.
10. Changes to these Terms
Provantis may update these Terms from time to time. Material changes will be announced on the
Platform and, where reasonable, by email at least seven (7) days before they take effect.
Continued use after the effective date constitutes acceptance of the updated Terms.
